nbc's michele kosinski is in south africa on the story for us this morning. michele, good morning. give us the latest. >> hi, savannah. oscar pistorius sobbed his body shaking as this ruling was read and you could say in many ways this was expected, but this judge kept everyone guessing. his ruling lasted two hours. he criticized the prosecution, then said that it doesn't mean their case is not strong. then he hit pistorius saying he has problems with his story about what happened that morning. ultimately ruling, though, pistorius is not a flight risk, not a danger to the public. he will be released on bail tonight. >> the accused is not a flight risk. >> reporter: listen to the reaction on audio feed at the moment the ruling on bail was finally read.
7:01 am
>> the accused has made a case to be released on bail. >> yeah! >> reporter: oscar pistorius entered the court with a calm demeanor looking more collected, even confident than we've seen. head forward, eyes closed. prosecutors picked up their argument, again ripping into pistorius' account of what happened the morning reeva steenkamp was killed in which a claim he was screaming, yelling for her to call police about a burglar and her in the bathroom without him knowing it. according to prosecutors she did not say a word. she did not scream. she did nothing. it's so improbable, it's not true. even on his statement he ran back in the bedroom saw reeva wasn't in the bed and realized what happened. i would imagine you'd look everywhere for her, downstairs, where is she. doesn't make sense to think i've shot reeva because she's not in bed. that would come later not immediately. prosecutors wondered why a guy worried about burglars slept with open windows and doors, why
7:02 am
he wasted time to go down to unlock the front door and criticized his attitude of i've done nothing wrong and looking forward to business as usual. tod today's attorney, confidence he will be released from jail, would like to start trending him again monday. though he has no plans to race, he thought training would be the best thing for him. >> to get his mind sort of cleared. the sooner he can start the better. >> reporter: his defense insisted whatever the alleged actions or circumstances may be, there is no evidence that this is murder at all, that pistorius was in a panic that night to save reeva, whose friends watched this hearing, minutes away from a ruling now and remember her. >> she actually sent me a message in the beginning of the month and she said, this month is going to be amazing and change our lives forever. >> reporter: the judge just upped pistorius' bail to 1
7:03 am
million ran, the equivalent of 112,000 u.s. dollars and lots of conditions on this. pistorius has to surrender his passport, firearms, can't use drugs or alcohol, can't return to the crime scene which is his home. he needs permission to leave his town and has to check in with police twice a week. savannah? >> all right. michele kosinski with the breaking news in south africa. let's turn to john cue kelly a defense attorney who's got a lot of experience covering trials. john, good morning to you. >> how are you doing? >> good. let's look at this bail decision in perspective. i mean on the one hand, we saw a judge who really ripped the prosecution's case, aspects of it, called into question aspects of pistorius' story. does the bail decision have any real influence on what will ultimately happen at trial? >> no, it doesn't. it did give us a good look in terms of how the evidence will be received at trial. the judge didn't base his bail decision just on the strength or
7:04 am
weakness of the prosecution's case. it had a lot to do with the community ties involved, propensity to violence, whether witnesses could be in danger, and no prior criminal record and he had to turn in his passport. they don't see him as a flight risk. the judge gave a lot of weight to the fact that pistorius came forward and put his vir version of events in an affidavit right up front. >> are you surprised at the same time to see so much substance in the context of a bail hearing? i mean, this spells at time like a mini trial and do you think that will ultimately affect the outcome of the case, that so much of the evidence has in some ways been previewed. >> both the prosecution gets a look at the defense case and the defense got a very good look at the prosecution case. it's very unusual. last time i think we saw this, the reason it sort of escalates through a worldwide media
7:05 am
frenzy, was the hearing where you gave a substantial airing out of all the evidence weigh before, media frenzy ahead of time. >> you mentioned the simpson case and there are some parallels. for example, you have a lead detective in the pistorius case who has absolutely been called into question in terms of his credibility. one because he's apparently facing murder charges of his own, but two, in terms of how he investigated the case. now he has been removed from the case, but that doesn't mean he won't play a role here, right? the defense can always call him. >> well sure. and he's a fact witness. he was here at the crime scene. he recovered evidence. he interviewed witnesses and, you know, even made determinations in terms of cell phone calls were made or not made and things like that. and you're right, the implication is rogue cop, same thing as we saw with furman in the simpson trial. it's sort of the perimeter issue, not related to the facts
7:06 am
directly but it makes it sexy and interesting. >> well, one thing you definitely know that's different between our country and south africa is the fact that it's going to be a bench trial. the judge will render a decision, not this judge, a different judge. not a jury. doesn't that really change what happens in a case? >> well, it does. i mean you don't have -- you know, with a jury of 12 laymen hearing the fact that the lead investigator had these attempted murder charges, things like that, it would be so compelling with a single trial judge, it won't be. i think where a lot of this is going to play out is on the world stage in the media. you know, they're going to make a lot more of this than will come into play with the trial judge himself. >> and a lot of times we do see when there is a lot of public coverage of a case that influences a jury, remains to be seen whether a judge will be influenced by that kind of thing. john kelly, noted defense attorney, always good to get your perspective. >> thank you. >> thanks, savannah. and now let's go back to willie. >> savannah, thank you.

7:08 am
across the region, snow is falling at a furious pace, challenging shovellers. >> trying to keep the sidewalks and everything clear. >> reporter: the storm is leaving behind some impressive snowfall accumulations. 10.5 inches in missouri. 12.5 in alva, oklahoma, and almost a foot and a half in hayes, kansas. in missouri there's a state of emergency. in kansas, state offices closed for all but essential workers. in texas the problem is ice. south of new deal, texas, a seven-car accident shuts down traffic on an interstate highway. you don't have to work or travel. it's a time for fun. >> she's playing all over the place in it, loving it. >> reporter: for this young girl, it's a chance to do something nice for dad. >> i am cleaning up the driveway so that when my dad gets home, he can find his spot and can get in the house for him. >> reporter: right now, at o'hare airport, about 240 canceled flights and delays for
7:09 am
inbound flights, up to 90 minutes. willie? >> john yang, like a lot of people this morning, bundled up in chicago. thanks so much. al is keeping an eye on the storm for us. al, what does it look like. >> it's going to continue to make its way to the east and also cause a lot of flooding down south. take a look, you can see on the radar, that you've got another area of snow still stretching through the great lakes, dropping maybe another one to three inches. also heavy rain, severe weather going on right now, down through the south. so as we look at the amounts we're expecting over the next 24 hours, about one to three, some areas as much as six inches of snow around the great lakes but also down south, from new orleans all the way into the carolinas, anywhere from three, as much as five inches of rain that could cause some flooding. other thing we're worried about, another piece of energy breaks off from the main storm, up the track of this system we could be looking at a decent amount of snow for new england. now, depending on where it sets up, that will determine where the heaviest snow is. right now the european model, which has been pretty good about
7:10 am
all of this, has basically showing about four to six inches of snow from boston, heavier snow to the west of boston. however, the american models are a little bit different. they show much less snow for boston. the heaviest snow makes its way into interior sections of new england, almost no snow for new york city. mostly a rain event from new york city and new jersey all the way down into much of the parts of the delmarva peninsula. we will have to keep watching this and plus there's another system that's going to be coming out of the pacific northwest today that's going to cause more problems for everybody who got hit in kansas, missouri and iowa earlier this week. >> this week is going to be a wild one. >> very active week. like flo rida. >> thanks very much. let's head back to new york for a check of the other top stories and check in with carl. hey, carl. >> good morning. good morning, everyone. a manhunt has intensified after a deadly shoot-out in the heart of the las vegas strip. nbc's miguel al mcguire is there with the latest.
